U.S. based affiliates of companies that use business visitor or employment-based non-immigrant visas have been under more scrutiny in the past few years. These companies are visa dependent of U.S. based workers and are particularly vulnerable. They often need these workers to fill skill sets not current in the U.S. work market (examples: IT, science and engineering jobs).
In a recent case, Guidepost Solutions assisted an Asian-headquartered technology company with a sizable U.S. office. We conducted a detailed look back review of the visa usage over the past ten years to identify vulnerabilities to their procedures as well as to help develop a detailed tacking system to document and evidence the proper usage of B, H, and L non-immigrant visas.
