Ken Citarella, Managing Director of Guidepost Solutions’ investigations and cyber forensics practice, was recently featured in a Credit Union Times article. The article discussed a ruling by a federal appeals court in Maine that held a bank liable for nearly $590,000 stolen from a client’s account by a cyber-criminal because, according to the court, the bank could have done more to prevent the crime. Until this ruling, banks were under the impression that if they provided a generally accepted level of security then they would not be liable for a breach. Ken Citarella said, “’The decision creates a dilemma for financial institutions. The court said a generic, one size fits all solution is not sufficient, but who said what is sufficient?’ Citarella suggested that one consequence of the ruling may be raised security demands for clients at financial institutions. ‘If this decision stands, every transaction may have to involve more inconvenience.’”

In a recent Wall Street Journal article, Guidepost Solutions Chairman Bart Schwartz commented on a settlement related to the Bernard Madoff bankruptcy between Attorney General Eric Schneiderman and J. Ezra Merkin. The settlement, which was reached in June is being disputed by Irving Picard, the court-appointed trustee for the Madoff bankruptcy. Mr. Schwartz, who acts as the receiver for some of the funds associated with Merkin’s investments said, “his office had entered into a ‘fair, legal and binding settlement’ and will ‘vigorously oppose any attempt to derail it.’”

According to the article, this pressure is a result of the increased regulatory scrutiny on how third-party vendors manage data and recent events such as Fidelity National Information Services, Inc. (FIS)’s 2011 breach. In the article, Ken Citarella offers his insights into how financial firms can protect themselves from similar breaches. Mr. Citarella suggests that many firms fail to learn lessons from well publicized breaches and encourages firms to look at past events to understand how systems are breached. He said, "Every time there's an intrusion to a major company there's a big write up about it. How else do you know how to protect themselves? By seeing [how] other people have been victimized. If you hire a security expert where do you think he gets his expertise from? He learns from the past.” Mr. Citarella also said that firms reviewing a prospective vendor should ask how it protects its security and show how its approach is effective. Still, Mr. Citarella places the ultimate responsibility for information security on the company, saying "They've got to monitor security with their third party vendors. Not to do so in this day and age with all of the problems we see every day in the newspapers is incredibly risky."
